📋 Description

• Adjust the most complex construction defect claims in the company's inventory • Establish the best and most cost-effective strategies for handling construction defect claims • Investigate, evaluate, and bring complex claims to timely resolution • Handle litigated claims and claims involving large construction projects • Handle complex coverage issues involving subcontractors and additional insured tenders • Manage Florida Chapter 558 processes and issue reservation of rights and denial of coverage letters • Interpret construction contracts and apply risk transfer when appropriate • Negotiate time on risk and the duty to defend and indemnify with liable insurers • Proactively manage litigation and work with defense counsel and insureds • Use resolution techniques including high-low agreements, proposals for settlement, and offers of judgment • Evaluate and respond to time-limit demands, consumer complaints, Department of Insurance complaints, and Civil Remedy Notices • Assess property damage and construction defect damages using contractor, engineer, and appraiser reports • Negotiate in mediations and assist with early resolutions • Maintain appropriate reserves on assigned claim files • Prepare reports detailing claim status, payments, and reserves • Communicate with appropriate parties and document claim files throughout the adjustment process • Maintain timely diaries on each claim • Assist, train, and mentor less-skilled team members • Assist managers in identifying trends and process, procedure, and claim-resolution improvements • Collaborate with underwriting and other departments on projects and perform other assigned duties

🎯 Requirements

• Knowledge of construction defect claims handling • Knowledge of applicable insurance policies, claims systems, and claims handling regulations, procedures, and laws in 48 states • Bachelor's degree in a related field or equivalent experience • Juris Doctorate a plus • Ten (10) years of construction defect claims adjusting experience • Experience with exposure to a minimum of $100,000 • Must hold a proper adjuster license in Florida and/or Texas and other states, with ability to obtain additional licenses as needed • Knowledge of construction defect coverage issues • Ability to understand and interpret construction contracts and apply risk transfer • Knowledge of residential and commercial building construction and repair processes • Ability to review and analyze damage reports prepared by contractors, engineers, and appraisers • Understanding of reserving requirements and philosophies • Strong negotiation skills in alternative dispute resolution forums
