📋 Description

• Provide day-to-day legal advice on wage and hour laws, FMLA, ADA, Title VII, and state-specific employment statutes • Address home care workforce issues including live-in caregiver exemptions, travel time compensation, and joint-employment risk • Monitor federal and state labor laws affecting Medicaid and healthcare sectors • Align employment practices with Medicaid provider enrollment rules, EVV mandates, and state program integrity requirements • Advise on background check compliance, exclusion screenings, and mandatory health screenings • Collaborate on audit readiness for state health departments and managed care organizations • Draft, update, and implement employee handbooks, arbitration agreements, and separation agreements • Review and structure independent contractor agreements and vendor contracts • Design and deliver employment best-practices training for HR and operational managers • Manage and resolve pre-litigation employment demands, administrative charges, and wage audits • Oversee outside counsel during employment litigation or class-action defense • Lead internal investigations into harassment, discrimination, or retaliation allegations • Advise executive leadership and HR teams on workforce management, compliance, and risk mitigation • May manage one or more paralegals

🎯 Requirements

• Juris Doctor Degree required • Current license to practice law required • Minimum of 10 years of focused labor and employment law experience required • Ability to apply state and federal anti-discrimination and wage-hour requirements to complex business operations • Ability to draft clear, well-organized position statements and legal documents • Ability to negotiate and draft settlement agreements and releases • Ability to manage state and federal employment-related litigation • Ability to communicate clearly and concisely with executive leadership and translate legal concepts into practical business solutions • Ability to provide sound legal and practical judgment and guidance • Ability to manage a high volume of urgent requests • Ability to apply state and federal information privacy and security requirements to employment matters • Ability to draft policies, contracts, and memoranda • Excellent legal, writing, and interpersonal skills • New York or California bar admittance is a plus • Prior in-house and/or large law firm experience is preferred • Labor relations expertise is highly desirable, including collective bargaining negotiations, NLRA compliance, labor arbitrations, union organizing matters, and employment risk mitigation • Experience supporting Medicaid HCBS programs is a plus
