📋 Description

• Management of judicial and administrative proceedings involving medical and hospital civil liability, including allegations of medical error, failure of care, hospital-acquired infection, death, permanent sequelae, and other adverse healthcare events; • Drafting answers, reply briefs, objections, memoranda and other strategic procedural filings; • Developing defense strategies for physicians, clinics, hospitals, and other healthcare institutions; • Reviewing medical records, expert opinions, care protocols, and hospital documents to define litigation strategy; • Drafting technical questions for experts and coordinating judicial medical examinations; • Reviewing and challenging expert reports, participating in the definition of the technical and expert strategy for cases; • Drafting appeals at all instances, including appeals, interlocutory appeals, motions for clarification, special appeals, and extraordinary appeals; • Participating in evidentiary and trial hearings, delivering oral arguments, examining witnesses and taking personal testimony; • Conducting doctrinal and case-law research related to medical and hospital civil liability; • Assessing procedural risks and preparing legal opinions and strategic reports for clients in the healthcare sector.

🎯 Requirements

• Law degree and active registration with the Brazilian Bar Association (OAB) for a minimum of 5 years; • Proven experience as an attorney handling medical and hospital liability cases, particularly in defending physicians, clinics, and hospitals; • Postgraduate degree in Civil Procedure; • Experience reviewing medical records and technical healthcare documents; • Experience attending judicial medical expert examinations and drafting expert questions; • Solid knowledge of Civil Law, Civil Procedure, and Tort/Liability Law; • Strong drafting skills for complex pleadings and appellate briefs; • Excellent analytical skills, legal writing, and strategic reasoning; • Organized, autonomous, responsible, and able to work collaboratively. • Preferred / Differential Qualifications: • Postgraduate qualification in Civil Liability, Medical Law, or Health Law; • Experience with high-complexity cases with significant financial or reputational impact; • Familiarity with care protocols, hospital practices, and medico-legal terminology.
